Lawsuits Filed Against the State

 

FEA recognizes that you don’t need to be a constitutional lawyer to recognize that the State hasn’t devoted sufficient resources to public education.

 


The Southern Legal Counsel public interest group filed a lawsuit contending that the State Board of Education, President of the Senate, Speaker of the House and Commissioner of Education have "failed to make adequate provision for education" and have "failed to provide a high quality system of free public schools that allows students to obtain a high quality education." Southern Legal Counsel, acting without the participation of the FEA, the Florida School Boards Association, Florida Association of District School Superintendents, Florida Association of School Administrators or the Florida PTA, wants the courts to declare that the State has failed in its paramount duty to provide a high quality system of free public schools providing a high quality education for students. The court is asked to direct the defendants "to establish a remedial plan that conforms with the Florida Constitution by providing a high quality system of free public schools that allows students to obtain a high quality education."

 

In November, the ACLU also filed a lawsuit on public education. In that legal action, the national and Florida American Civil Liberties Union brought a class-action suit against the state on behalf of Palm Beach County students and parents, alleging it fails to ensure that all students receive the high-quality education guaranteed under the Florida Constitution. The lawsuit does not seek monetary damages, but asks a judge to set goals for increasing the district graduation rate over time.

While we will monitor the legal actions, we have taken no position on these lawsuits, one way or the other. When asked by media outlets, we’re saying just that.
